Who is UA 787?
HVACR LIFE
The work we perform is in the air conditioning, refrigeration and mechanical systems industry. HVACR. This includes ICI construction, residential construction and the service & maintenance sectors.
Our work covers installation, retrofit, service, maintenance and repair of all aspects of comfort cooling and heating, as well as process cooling, ammonia, glycol systems for cold storage and ice rinks, pharmaceutical plants, supermarket refrigeration, facility management, building automation and controls, and many others.
On April 14, 1951, Local Union 787 was issued a charter from the United Association of Journeymen and Apprentices of the Plumbing and Pipefitting Industry of the United States and Canada. Our jurisdiction encompasses the province of Ontario.
We have over three hundred (300) contractors signatory to our Collective Bargaining Agreements. Our journeyperson and apprenticeship training school is one of the finest in the United Association.
We have the best trained craftspeople in the air conditioning, refrigeration, and mechanical industry in North America, and we strive for the best.

What are the rights of an employee?
An employee has the right not to be discriminated against or penalized by an employer or by a trade union because he or she is exercising his or her rights under The Labour Relations Act, 1995.
An employee has the right to cast a secret ballot on items that affect their employment and working conditions.
An employee who is a member of a trade union has the right to recieve, upon request, copies of the audited financial statements of the union and its pension, vacation pay and welfare trust funds or plans.
What are the rights of an employer?
An employer has the right to express an opinion about trade unions so long as it does not use coercion, intimidation, threats, promises, or undue influence.
An employer has the right to demand that the trade union that has barganing rights for its employees bargain in good faith and make every reasonable effort to make a Collective Agreement.
An employer has the right to demand that employees and their trade union honour the terms of the Collective Agreement between the employer and the trade union.
What are the rights of a trade union?
A trade union has the right to require an employer not to penalize or discriminate against any employee because the employee supported or partcipated in legitimate trade union activity.
A trade union has the right to demand that an employer not interfere with its formation, selection or administration.
A trade union that hold bargaining rights for the employees of an employer has the right to require the employer to bargain in good faith and make every reasonable effort to make a Collective Agreement.
A trade union has the right to demand that the employer complies with the terms and conditions of the Collective Agreement between it and the employer.
A trade union that holds bargaining rights for the employees of an employer has the right to demand that the employer not engage in bargaining with individual employees or other trade unions in respect of those employees for whom it holds bargaining rights.

ORGANIZING PROCESS
In Ontario in the HVAC&R Trade if the Union can show that they have more than 55% of the workers have signed a card, working on a specific day the Union can apply for what is known as a card-based certification. This application if successful would see the company become Union for “Construction” and there would be no further vote. If the Union does not have more than 55% of the employees’ support the Ontario Labour Relations Board would order a vote.
At or about the same time due to the nature of the HVAC&R Trade, where there are employees that would be performing non-construction work such as routine maintenance, the Union can also apply for what is known as an Industrial Application that would cover Service and Maintenance. This application would require that the employees vote, and to be successful the Union would need a vote of more than 50% of the employees in favour of the Union for the Union to be able to represent the employees.
